Dumping Appeal Fails

A USA trade court has rejected an Indian exporter’s appeal of a USA Commerce Department decision to levy dumping duties on its shrimp.

The decision by the USA Court of International Trade (CIT) is a setback for Apex Frozen Foods Private Ltd., which sought to challenge the department’s imposition of dumping duties.

Apex argued that the Commerce Department didn’t have sufficient proof to justify imposing the duties but the CIT disagreed, finding that there was “substantial evidence.”

The attempt was Apex’s second effort to get the duties lifted after a similar effort last year.  That try was also unsuccessful
